These are just a few convoluted words. A sentence written by the public prosecutor of Chambéry (Savoie) which however changes everything. According to the magistrate, Nordahl Lelandais must be accused of having killed Corporal Arthur Noyer, 24, his first alleged victim, but not of having murdered him. He has thus just requested the return to the assize court of the former dog handler - also suspected of having kidnapped and then killed the little Maëlys - for murder, on the grounds that the investigation did not "permit establish with certainty the premeditation. The lies of the indicted (Nordahl Lelandais, Editor's note) being insufficient to characterize this element. The investigating judge will make the final decision in the coming weeks.
Before this decision, the choice of counsel was a blow to the parents of Corporal Noyer. "Since we received his requisitions, we have gone through frustration, anger, and now misunderstanding", breathes Cécile Noyer, the mother of the former Alpine hunter, met this Thursday, February 20 in the morning a park in downtown Bourges (Cher) where a skatepark is named after Arthur Noyer. "Since December 20, 2017, Nordahl Lelandais has been indicted for murder in Arthur's case," she continues. This was never disputed by the parties, even Lelandais did not contest this qualification initially decided by the prosecutor. And there he changes his mind. I do not understand. "
"A predator on the hunt"
Corporal Noyer disappeared on the night of April 11 to 12, 2017 in Chambéry after getting into Nordahl Lelandais' car. His remains will not be found until January 2018, on a path about fifteen kilometers from the place where he was hitchhiked. It is the work of the investigators on the little Maëlys, who disappeared a few months later, which will allow Nordahl Lelandais to be implicated in this murder. On the evening of Arthur Noyer's disappearance, his telephone bounded at the same relay points as that of the victim.
Above all, Lelandais' car, a gray Audi A3, had been picked up by surveillance cameras going back and forth on the path where he had hitched Arthur Noyer. "When we see on the videos of the city a predator chasing a victim, when we see him spinning on foot, in a car, if it is not premeditation, that surprises me, denounces Didier Noyer, the father of Arthur. It happened to be my son, but it could have been anyone. That evening, he was hunting, he wanted to satisfy his instincts, and, unfortunately, it fell on Arthur. The premeditation is there, and there are many other elements in the file. "
Armed with this conviction, the parents of Arthur Noyer believe that the prosecutor should have requested the dismissal of Lelandais for murder. "When we read the words of the prosecutor, we understand that the lies of Lelandais play in his favor, annoys Cécile Noyer. It is not possible, we roll out the red carpet. It is not up to us to prove what seems obvious. I would rather hug my kid, tell him that I love him, rather than fight to be heard by the law. "
The impression of not being of interest to justice
“A man alone in his office should not make this decision, also contests Didier Noyer, on the verge of tears. We are just asking that the Assize Court be able to give its opinion, that jurors decide whether it is a murder or an assassination. There is no question of letting it pass. The rights of families are being violated. The Noyer family even fears that this opinion of the prosecutor is only motivated by timing issues, in order to avoid a defense call which would delay the trial.
A situation that "adds suffering to the suffering of these parents who have lost a child," laments Me Bernard Boulloud, their lawyer. Since the disappearance of their son, Arthur Noyer's parents have kept the unpleasant impression of not being interested in justice. "Even if we make the difference between the investigators and the justice system, we have the feeling that we didn't worry about Arthur's disappearance until Lelandais entered the picture," says Cécile Noyer.
