Augsburg (dpa / tmn) - traffic signs can also be valid if they are not completely designed in accordance with legal requirements. If only the font and spellings differ, this is not an argument for drivers not to stick to them.

This shows a decision of the administrative court Augsburg (Az .: Au 8 K 19.918), to which the ADAC draws attention.

The case concerned a driver who had parked his vehicle in a parking lot. Under the parking sign, which shows a white P on a blue background, additional signs were attached, which regulated that only severely disabled people were allowed to use the parking space for a certain period of time on the day in question.

However, these additional signs did not meet the requirements of the Road Traffic Ordinance (StVO), but had been labeled by employees of the Ordnungsamt with a different font and size. The times were given the word "clock" instead of "h".

The victim's vehicle was towed because the man did not have the necessary severely disabled ID. He defended himself against the towing fees. He was of the opinion that the additional characters attached were formally void, since they did not meet the requirements of the StVO. The authority insisted on payment and the matter went to court.

A slightly different design is not sufficient for invalidity

However, the administrative court found the authority right. The reason: A traffic sign is an administrative act by the authority. However, such is only void if it is no longer recognizable to those affected that there is official action. Accordingly, a traffic sign is not void solely because it differs in design from the StVO.

In the negotiated case, the basic design features were observed. A different font size alone does not make the sign incomprehensible. The use of the word "clock" instead of "h" is a deviation from the StVO, but is clear. The shield was thus effective and the towing was lawful.
