Berlin: Senate does not remove pop-up cycle paths for the time being

Despite his defeat before the administrative court, the Berlin Senate does not want to remove the pop-up cycle paths created during the corona pandemic for the time being.

Probably in the coming week, the traffic senate administration wants to lodge a complaint with the higher administrative court against the urgent decision, as the broadcasting Berlin-Brandenburg reported with reference to a spokesman for the senate administration.

It had previously announced that it wanted to ensure that the complaint had a suspensive effect.

Administration should have asserted the danger situation

That would mean that the temporary bike paths do not have to be removed for the time being.

The Berlin administrative court had previously announced that it had "serious doubts about the legality" of the routes.

It obliged the Senate Administration to remove the relevant signs.

As a justification, the court announced that the Senate should have asserted a specific danger situation before the establishment.

According to the court, the Senate Administration of Senator Regine Günther (Greens) stated that the reason for the bicycle lanes was that in the pandemic it was necessary to ensure system-relevant mobility.

The fact that the majority of Berliners do not have a car and that the minimum distance on public transport can hardly be observed justifies the establishment of the cycle paths, for which a lane has been removed from car traffic in many places.
