Judgment in Berlin: owner must renovate decaying house

Since 2010, the so-called haunted house in Friedenau is empty. Now a court has decided that the owner must make the tenement habitable again.



A homeowner may not let her Berlin apartment building expire in light of the housing shortage. This emerges from a judgment of the administrative court of the city.

Therefore, the woman could not sufficiently explain that the effort was unreasonable for her to repair the house with 16 apartments. That's what the district office demands of her.

Haunted house is empty since 2010

The so-called haunted house in Friedenau expires and is empty since 2010. In 2015, the competent district office ordered that the owner have to restore the house at their own expense. The basis for this was the ban on the use of living space, which has been in force since 2014 and is intended to alleviate the housing shortage.

The homeowner complained. However, the General Court found that the action was inadmissible because the woman did not object in good time. In addition, the prohibition of alienation also applies to housing, which had shortcomings even before the law came into force - as long as you can still restore the house with reasonable effort.
