Rejected: homeowner must pay compensation

In his apartment ad the landlord from Augsburg made it clear that he does not want foreigners in his house. The district court Augsburg finds clear words for it.



Due to discrimination of a prospective tenant, a homeowner must pay 1000 euros compensation to the man from Africa. The Augsburg district court also decided on Tuesday that the landlord should not once again leave an ad with a wording, after which he rented only "to Germans". Otherwise, the owner is threatened with high fines.

The court completely upheld the lawsuit filed by the Burkinabe applicant. "This open discrimination against foreigners is simply unacceptable," said Judge Andreas Roth (Az: 20 C 2566/19).

The prospective tenant had reported in the process that already the first phone call from the landlord was terminated when it was clear that he had a migration background. The apartment owner had admitted that he only wanted to rent to German citizens. He accused the plaintiff that he was not really interested in the apartment.

The 81-year-old justified his xenophobic attitude with the fact that he had once had trouble in his house with a supposedly Turkish drug dealer. "Crimes and offenses are committed by people, not by nationals," the judge said.

In the past, other courts had already awarded foreigners damages if they had been turned away from homeowners because of their origins. The Federal Anti-Discrimination Agency estimates that around 70% of people with a migrant background feel discriminated when looking for accommodation.
