The mobile operator Telefonica Germany has to pay 225,000 euros mobile credit to a customer who has accumulated a small fortune with call credits. This was decided by the Munich Higher Regional Court on Thursday after several years of litigation.
The man had taken advantage of a promotional pledge of the so-called "Easy Money" campaign Telefonica brand O2 for himself. With prepaid cards with easy money function Telefonica customer wrote long for each minute of conversation two cents well.
The customer had purchased a total of 508 such prepaid cards and turned the marketing gag intended for customer advertising into a lucrative business model: He used redial apps to permanently call himself.
The way to easy money was then stony than initially thought and initially led to two court instances: Telefonica had the 508 cards first blocked in 2015, then terminated the contracts and finally denied the payment of the credit.
The argument of the group: The customer violated both the general terms and conditions as well as good faith. The latter refers to the fact that the two-cent credit per call was not meant for customers calling themselves thousands of times with computer assistance.
Then the man went to court, and has now prevailed. The court did not allow a revision.
