European justice rejected on Wednesday the appeals brought by the company Nord Stream 2, the operator of the pipeline project led by the Russian giant Gazprom between Russia and Germany, to cancel the new EU rules on transport some gas. Nord Stream accused the EU of having adopted these new provisions in order to " disadvantage " and " discourage " Gazprom with regard to the establishment of this pipeline.

" The Court notes that the companies Nord Stream 2 AG and Nord Stream AG are not directly affected " by the change in rules, explained the European Court of Justice in the reasons for its judgment, ruling the applications " inadmissible ".

" Nord Stream is part of a restricted circle identified or identifiable from operators concerned by the application of the provisions of the new regulations " and " cannot consider that it is individually concerned ", maintained the judges.

The new European provisions adopted in 2019 impose the same common market rules on pipelines from a country outside the EU and crossing the block, with the aim of price transparency, third party access to infrastructure and the separation of activities between suppliers and network managers.

Nord Stream 2 AG and Nord Stream AG are Swiss companies, 100% and 51% owned by Gazprom. They had seized European justice to denounce a European legislation " clearly conceived and adopted with the aim of disadvantaging and discouraging the gas pipeline Nord Stream 2 ", maintained their leaders.

" Such obvious discrimination against individual business investment also undermines the ability of the EU internal market to attract investment to make the energy transition a reality, " said Matthias Warnig, CEO of Nord Stream 2 AG.

The operator had decided to go to European justice after the failed attempts to find an amicable settlement with the European Commission. Nord Stream 2 argues for obtaining a derogation, provided for in the new regulations but which only applies to " complete " projects when the new rules come into force.

The Court explained that it was up to the authorities of the member states to make the provisions of the new legislation binding and that these same authorities decided to grant exemptions.

The Nord Stream 2 pipeline project associates the giant Gazprom with European companies (the Germans Wintershall and Uniper, the Anglo-Dutch Shell, the French Engie and the Austrian OMV).

Almost complete, it should double the volume of direct deliveries of Russian natural gas to Western Europe via the Baltic Sea to reach Germany
