In this " collective complaint by a mandated association ", consulted by AFP, the LDH " considers that the companies Uber BV and Uber Technologies Inc. (...) violate on numerous occasions, voluntarily and this, towards a very large public of drivers (...) with the provisions of the GDPR and the Data Protection Act on French territory ". It is " impossible for Uber drivers to access their personal data, but it is their right " and " when they get there, they are unusable and unintelligible because they are files in English, " AFP said. Maryse Artiguelong, one of the vice-presidents of the LDH.

"The issue of access to this data is important because it protects their private lives but also serves to respect their economic and social rights, which are violated by Uber, " she said. These data are " important to prove the link of subordination " between the platform and its drivers, under self-employed status, and to reclassify their contract as an employment contract, notes Brahim Ben Ali, secretary general of the INV union and himself engaged in proceedings against Uber at industrial tribunal.

A fine imposed in 2018

The complaint before the Cnil is based on about twenty drivers but others will be added to it, affirmed to AFP Jérôme Giusti, lawyer of the LDH, which plans to initiate in the coming months a group action before the Paris court to " request individual compensation ". " Uber drivers are already exploited as drivers, but they are also exploited as click workers because they are producers of data for which they are not paid, " said Giusti.

Uber France says it has responded to requests from 500 drivers. " Our privacy team works to provide as much information as possible, including explanations when we cannot provide certain data, for example when the data does not exist or if its disclosure would prejudice another person's rights under the GDPR, "said an Uber spokesperson.

In December 2018, the CNIL imposed a fine - then record - of 400,000 euros on Uber for having " insufficiently secured the data of users " of its service.
