Coronavirus: Michelin-starred chef Michel Sarran "disgusted" after losing to his insurer

According to Axa, its insurance contract does not cover "collective administrative closures caused by an epidemic affecting several establishments in the same department".


The Toulouse commercial court on Tuesday dismissed Toulouse chief Michel Sarran, who asked his insurer Axa to compensate his operating losses, estimated at more than 180,000 euros, due to confinement following the coronavirus pandemic.

"I am unsuccessful and disgusted, it is devoid of common sense, I am going to appeal" , reacted to AFP the chef who has a two-star restaurant in Toulouse and is a member of the jury for the Top Chef show on M6. "This decision was expected because it is the first judgment (in France) on the merits of our standard insurance contract, proposed by general insurance agents" , for its part underlined Axa in a press release sent to AFP. “We were therefore heard by the court which recognizes the validity of our exclusion clause , adds the insurer.

In its judgment, the court indicates that "the extension of guarantee relating to operating losses following an administrative closure due to an epidemic is accompanied by an exclusion clause which is applicable in this case" . Axa then told AFP that "the insurance contract in question today very explicitly provides that collective administrative closures caused by an epidemic affecting several establishments in the same department are not covered" .

“In practice, there are many cases of establishments having been the subject, in recent years, of purely 'individual' measures of administrative closure due to epidemics (salmonellosis, listeriosis, etc.) by municipal decrees or prefectural ” , according to the insurer. "These situations may give rise to compensation under the terms of our contracts with a wording identical to that of SARL SARRAN" , according to Axa.

"A complexity without a name"

But for the Toulouse chief, "it will now take three lawyers and two doctors to take out an insurance contract, it is unnamed complexity" . He assured to lead this "fight" for him but "also for the profession with colleagues much more impacted" , of which "some will not pass the course" . Especially since "the health situation is absolutely not under control" , he noted. "I am also fighting because the insurance companies have not shown good will, solidarity" during the health crisis, he said.

Several restaurant customers of Axa have taken the insurer to court, accusing it of refusing to compensate their operating losses due to confinement. At the end of June, Axa announced that it had reached an agreement with several hundred restaurant owners to compensate “a substantial part” of their operating losses linked to the Covid-19 crisis.
