She is a scientist, a citizen of a foreign country in her 40s. For 10 years she has been commissioned for important research, but does not abandon her hobby: sports. She loves sports as much as she loves research. On this fateful morning her life will change forever.

It all started when during a routine run the scientist was run over by a truck and suffered multiple systemic injury and death. As a result of the severe injury, the study, which she commissioned in a university laboratory, was erased from her memory. She was found lying on the road unconscious. She was rushed to the scene of the accident by an intensive care unit to the hospital, where she underwent life-saving surgery. Because she suffered from cerebral hemorrhage she was hospitalized in the intensive care unit while she was anesthetized and breathing.

After a long and tedious rehabilitation she returned to sports, her favorite hobby of all, but for a young researcher and scientist whose whole future was ahead of her, the most severe injury is the cognitive impairment. All her attempts to recall a study she had commissioned for 10 years had vanished. But does research I have stored in memory have any monetary value?

The lawsuit against the insurance company, which was filed in the Tel Aviv Magistrate's Court through attorneys Jonathan Meyer and Little Schwartz of the Schwartz-Meyer-Barda law firm, showed that the investigator has no memory of the serious accident or hospitalization. Only at the Rehabilitation Medical Center did she open her eyes for the first time and awaken to the new and sad reality. Since she could not work again as a researcher in the laboratory, it was decided not to renew her employment contract at the university, and as a result her work visa and stay in the country was canceled and she was forced to leave her job and return to her homeland.

No less than eight court-appointed medical experts determined she had a permanent disability of 68%. One senior neurologist's opinion reads: "Return to part-time job as a scientific researcher, but fails to advance postdoctoral work due to cognitive disability also related to brain damage as a result of the accident ... It should be noted that before the accident she was a successful young scientist, and about two years later remained disabled. A cognitive that interferes with her work as a scientist. " The lecturer who employed her wrote: "Although it was clear to me that after the accident her productivity would suffer, I did not expect to see how limited the ability and concentration she brought to the lab was ... it was clear to me that the person joining the group now is not the same person who arrived before the accident."

After a long legal battle with the insurance company of the offending truck driver, she was recently paid compensation in the amount of NIS 1,863,060, in addition to hospitalization and rehabilitation expenses in the amount of NIS 250,000 and an advance of NIS 25,000.

Lawyer Meyer explained: "This is a serious car accident, when only thanks to her stubborn sports spirit and the tremendous scientific rehabilitation efforts returned to physical activity. Financial compensation, however large, never returns the victim to where he was before the accident. However, as in this case "The injured party is embarking on a new path and the compensation obtained for her will constitute an economic safety net for the rest of the way."

Attorney Schwartz added: "In this case we made sure that the victim received an initial payment that would help her financially during the rehabilitation period after the accident as well as payment for all hospitalization expenses amounting to hundreds of thousands of shekels. The compensation, however large, could not reflect the pain and suffering caused by the accident."
