Until when will rental prices and UVA mortgage loan installments be frozen?

The Government published the decrees in the Official Gazette that extend the benefit that began in March. Evictions will also be suspended.

As the Deputy Chief of Staff, Cecilia Todesca, had anticipated, the Government on Friday made official the freezing of rental prices and mortgage loan installments and extended the suspension of evictions.

It did so through the publication in the Official Gazette of decrees 766/2020 and 767/2020, within the framework of the coronavirus pandemic.

As detailed in the first rule,

the rental price is frozen until January 31 of next year,

which should keep those in force last March, when the Decree of Necessity and Urgency was issued in the middle of the start of the quarantine for the coronavirus .

Meanwhile, the evictions and the term of the contracts will also be suspended until January 31.

"We are going to continue accompanying people who rent because we understand that these months have been difficult, that

families have not yet been able to recover all the income they have lost as a

result of the pandemic," Todesca had explained.


Decree 766 also extends until

February 2021 the start of payment of debts due to price difference

under the same terms and conditions, and until January 31, 2021 for debts due to non-payment.

In addition, the mandatory mediation is extended for a period of 6 months, starting on March 30, 2021 and the suspension established previously.

"That the evolution of the epidemiological situation and the serious prevailing social situation require that rapid, effective and urgent measures be adopted, which is why it becomes impossible to follow the ordinary procedures for the sanction of the laws," the decree points out among the arguments.

Regarding the mortgage loan installments, Decree 767/2020 establishes the extension of the freeze until January 31, 2021. 

In addition, it provides for the suspension of executions until the same date, be they "mortgage, judicial or extrajudicial", a measure that reaches the "launches already ordered" and that had not been carried out.

Also, the decree orders that the mortgage loan installments that fall on properties destined for a single home and must be paid between February 1, 2021 and July 31, 2022 may not exceed the value determined in a convergence scheme prepared by the executive power.

Another important point is the one that establishes that the debts that may be generated from October 1, 2020 and until January 31, 2021, originated in non-payment or due to payments made after the deadline or partial payments, may be converted to Purchasing Value Units (UVA) and refinanced to be paid from the end of the current loan schedule, in installments that may not exceed the original loan installment.

Finally, accumulated debts may be refinanced, and adds that "the parties may agree on a different form of payment that may not be more burdensome for the debtor party."
