Wirecard investors are suing the federal government and Bafin: the state should pay

Investors accuse the financial regulator of being jointly responsible for the bankruptcy of Wirecard and are taking them to court. Do the claims for damages have any chance of success?

The Wirecard bankruptcy destroyed billions.

And since there is not much to be gained from the people in charge of the scandal group - the supervisory board and board of directors - shareholders and creditors fall back on another twist in order to cushion their losses if possible: They are suing the state.

The lawyer Andreas Tilp has already filed an official liability suit against the financial supervisory authority Bafin.

Investors are demanding compensation from the German Accounting Inspectorate (DPR).

And now, according to SPIEGEL information, the protection community of capital investors (SdK) and London hedge funds are taking direct action against the federal government: They are preparing so-called state liability suits.

The state must be responsible for ensuring that the supervisory authorities do not act to limit the damage.

Such complaints against the state and its authorities are rare.

In the Wirecard case, however, the public sector has made itself vulnerable - an accusation that a parliamentary committee of inquiry is also dealing with.
