Rental apartments in Berlin: upper limits, staggered according to year of construction and equipment

The second stage of the controversial rent cap in Berlin comes into force on Monday.
This means that landlords have to lower the rent if they exceed the upper limits stipulated in the law by more than 20 percent.
The Federal Constitutional Court rejected an urgent application from a landlord against the lowering at the end of October.
If the law declares it unconstitutional in the coming year, rents could be requested retrospectively.
With the first stage of the lid, the rents for almost 1.5 million apartments were frozen retrospectively to their status on June 18, 2019.
Rent may increase from 2022, but only by 1.3 percent annually.
In addition, upper rent limits were introduced, staggered according to the year of construction and equipment of the apartment.
The only exceptions are new build apartments that were ready for occupancy from 2014.
The law is limited to five years;
several lawsuits against this are pending in Karlsruhe.
