The alliance is again averting an impending defeat: Between the Corona-related, closed Munich host Guido al Duomo and Germany's largest insurer, there is a settlement a week before the planned verdict.
The parties have agreed not to disclose the details, as Allianz announced on Thursday.
First the magazine "Wirtschaftswoche" reported on the process.
In the process, the landlord had demanded 160,000 euros from Allianz for the official closure of his restaurant during the first lockdown last spring.
Allianz declines payments because the company does not see an insured event.
Insurance against company closures due to infection protection
The disputed insurance contracts explicitly apply to company closures based on the Infection Protection Act.
The coronavirus is not included in the list of diseases and pathogens listed by Allianz for which insurance cover applies.
On the other hand, only payments in the event of company closures due to prion diseases are specifically excluded - this applies to mad cow disease, BSE and related pathogens.
The Munich regional court had criticized these insurance conditions several times as being non-transparent and therefore offered the plaintiff landlords a good chance of success.
In a similar case, Allianz had previously reached an out-of-court settlement with the landlord of the well-known Munich tavern on Nockherberg, from which the annual politician riot was broadcast by Bayerischer Rundfunk before the pandemic.
However, according to the company, Allianz won in other courts.
"All twelve previous judgments relating to Allianz confirm our legal opinion that company closures due to / with COVID-19 are not insured in our contracts," said a spokesman for the group.
Nationwide, hosts have filed several hundred lawsuits against several insurers.
