"It's illegal," says Eric Baptista, the boss of the Temmos mountain hotel group, who has filed a complaint against AEW in the Bonneville court.

Many owners of commercial premises accept a postponement of the payment of rents of their tenants affected by the crisis.

But some are fighting to get paid.

Eric Baptista, the boss of the Temmos mountain hotel group, pays the price.

It operates five hotels in Savoie.

Two are housed within the Mont-Blanc Tourisme subsidiary, owner of the business only, the premises belonging to the real estate asset management company AEW, an affiliate of Natixis (BPCE group).

Unpaid rents, a new source of litigation

Closed for several months due to lockdowns, the hotels then saw their turnover collapse due to the absence of tourists and the cancellation of seminars.

The hotelier is running over a year in rents.

AEW estimates the bill at 2 million euros.

Eric Baptista disputes the amount, because the hotel restaurants are closed for administrative reasons.

The hotelier and his owner have started negotiations under the aegis of the commercial court.

In vain.

At the beginning of February, AEW, which holds a guarantee on the rents of 2 million euros, seized part of the bank accounts of Temmos, on which were placed 2.3 million of loan guaranteed by the State (PGE) granted ... by banks of the BPCE group.

“It's illegal,”

says Eric Baptista, who filed a complaint against AEW in the Bonneville court.

“Discussions have been opened with this tenant since June 2020, and we have had the opportunity to formulate multiple support proposals

,” defends AEW.

These proposals were systematically refused by the tenant. ”
