The AFIP extended the suspension of embargoes and tax executions for SMEs

The Federal Administration of Public Revenues (AFIP) extended until March 31 the suspension of the initiation of tax execution trials and the blocking of precautionary measures against micro and small companies.

The officialization of the measure came this Monday, through General Resolution 4936/2021, which was signed by the head of the AFIP, Mercedes Marcó Del Pont, and which was published in the Official Gazette.

In this way, the Government seeks not to hinder the activity of taxpayers who carry debts, with the aim of stimulating the reactivation of the national economy, seriously affected by the coronavirus pandemic.

As the document indicates, the benefits reach "those who have the status of Micro or Small Companies registered in the 'Register of MiPyMES Companies" or who "develop as their main activity declared according to the' Classifier of Economic Activities', any of economic activities critically affected. "

In addition, it is clarified that, until March 31, 2021, inclusive, is suspended "the locking of embargoes on funds and / or securities of any nature, deposited in financial entities or on accounts receivable, as well as the judicial intervention of cash , in the case of taxpayers or responsible persons not included "in the previous categories.

Regarding this last concept, it was clarified that "the measures detailed above may be requested from the competent judge, which will not be blocked by the representative of the Treasury until the end of the foreseen period." 

Apart from the Resolution, it was announced that the "actions necessary to collect the tax revenues owed by those economic sectors that are currently not critically affected will continue."

Meanwhile, tax executions will begin on large and medium-sized companies that do not carry out critical activities, which "reach less than 1% of all taxpayers in the country."

"Half of the debts that will be claimed from large and medium-sized companies correspond to funds that have already been collected from a third party," said AFIP.
