Rent law: deputies and real estate brokers ask for its repeal

The referents of the sector seek to repeal and change the law that was passed in July last year, according to their understanding,

The first meeting was attended by: Armando Pepe, President of the College, and Hernán Iradi, Secretary of the Institution, with the National Deputy Álvaro González (PRO, CABA), and after the meeting on Tuesday he presented a project to advance in this regard.

"We are glad to be finally being listened to by national legislators, something that had not happened when progress was made in the enactment of this harmful Law, which is only fair about it being equally damaging to all parties", Armando Pepe explained.

The new current law has among its most outstanding points:

  • the extension of contracts for a minimum term of three years

  • updating the values ​​on an annual basis

    and through an index prepared by the Central Bank, which combines the evolution of private sector wages and inflation.

“We hope that it will not be long before the majority of the Deputies and Senators of the Nation recognize the failure of the norm, and

progress can be made as soon as possible in its repeal and modification

, providing the sector with the predictability that both tenants and owners need.

Projects

One of the projects that turn to modify the law passed last year is the deputies of Together for Change, Luciano Laspina, Jorge Enriquez and Alberto Asseff.

They seek to repeal and modify the regulations.

Its main point is to generate tax benefits for the construction of rental housing, and maintain tax incentives for the construction of real estate.

In this it is promoted that the eviction action is carried out through a summary trial, which allows the judge to order the immediate delivery of the property.

Another project, also, of Juntos por el Cambio, by deputy Álvaro González proposes two modifications:

changing the minimum term for rent

, which with the new law went from two to three years, and it seeks to go back, and repeal the annual update and Hernán Iradi.


End to the price freeze

The Minister of Territorial Development and Habitat, Jorge Ferraresi confirmed on Tuesday

that there will not be a new extension of the rent freeze

and suspension of evictions but that the tools generated by the new Rent Law will be used, and highlighted the resources allocated by the State to generate housing solutions.

The decree that freezes rents and suspends evictions ends on the 31st of this month, and from that moment the tenants who had difficulties during the pandemic to comply with the contracts will have to start paying the accumulated difference in installments.


"The Rent Law was regulated and evictions have to go through the Ministry of Justice for mediation, there will no longer be an extension of the DNU,"

said the minister in dialogue with Télam, referring to the measure adopted by the national government during the pandemic months to protect tenants.

The official reaffirmed that "there is no extension, the strongest thing in the regulation of the Rent Law is the mediation of evictions and the registration of contracts in AFIP."

The Rentals Law establishes that the Ministry of Justice must provide free or low-cost mediation and arbitration areas for the resolution of conflicts arising from rentals.

Meanwhile, the obligation to register contracts in AFIP came into effect this Monday, and

owners who do not have the contract registered may be fined,

while they will not be able to carry out eviction proceedings.

The implementation of the Registry of Real Estate Locations allows the entity headed by Fernanda Raverta to

simplify the procedure for tenants to deduct their rents from Income Tax

.

"Tenants who declare their contracts in the registry will be able to access the deduction of up to 40% of

the amount of the rent without having to present an invoice issued by the landlord," said AFIP.

According to the agency, "the number of people who actually have access to this benefit is very limited", and "this responds to the fact that very few property owners issue the necessary invoices."

To simplify the procedure and guarantee access to the benefit, when a tenant presents his contract in the registry, the possibility of deducting the corresponding portion of the Income Tax

will appear automatically

in the System of Registration and Updating of Deductions of the Tax to the Earnings (Siradig).
