The crime of ecocide, a new threat for businesses

The legislative text which aims to strengthen the legal arsenal against environmental damage provides for very heavy penalties.


“To what extent will the ecocide be economicidal?”

Asked the iFRAP Foundation at the beginning of January, a liberal think-tank which campaigns for better management of public policies.

The question has not finished worrying economic players, while the creation of this new offense was voted in a special committee by the deputies on the night of Thursday to Friday.

Flagship measures of the climate and resilience bill, resulting from the work of the Citizen's Convention for the Climate (CCC), which today considers the text unconvincing, this offense aims to strengthen the criminal penalties applicable in the event of intentional pollution of water, air and soil.

It provides for very heavy sentences of up to ten years in prison and a 4.5 million euro fine.

If business leaders agree to recognize the need to protect the environment, they are on the other hand very irritated by the very use of the term "ecocide".

This terminology is extremely negative and stigmatizes companies
