The Federal Constitutional Court rejects an urgent application against the EU's Corona development fund

Karlsruhe paves the way for the EU's 750 billion euro reconstruction fund. The constitutional judges reject an urgent motion against the common debts.

From the German side, nothing stands in the way of the European Union's 750 billion euro reconstruction fund.

The Federal Constitutional Court refused to stop the EU borrowing necessary for this.

The urgent application by a citizens' initiative to the AfD founder Bernd Lucke was unsuccessful.

Federal President Frank-Walter Steinmeier can now sign the relevant law for the national implementation of the EU's own funds decision.

The Bundestag had approved the joint borrowing of the EU countries for the reconstruction fund on March 25 with a two-thirds majority, the Bundesrat followed a day later. On the same day, the alliance submitted an urgent application and a constitutional complaint in Karlsruhe. Thereupon the Second Senate forbade the Federal President from signing the contract until the decision on the urgent application was made. The constitutional complaint of the Citizens' Wills Alliance remains pending even after the decision on the urgent motion. When the Federal Constitutional Court will decide on the main issue has not been announced.

The plaintiffs argue that the EU treaties prohibit joint borrowing.

The Federal Government and the EU Commission, on the other hand, refer to Article 122 of the EU Treaties.

According to this derogation, in the event of natural disasters or exceptional events, a Member State can be granted "Union financial assistance under certain conditions".
