Cum-ex tax scandal: the public prosecutor's office takes a look at the ex

In the cum-ex scandal surrounding the MM Warburg bank, the Cologne public prosecutor's office is now also investigating the former head of the Hamburg tax office for large companies.

SPIEGEL learned this from the judiciary.

Accordingly, it is about the suspicion of a false, unofficial testimony before the Bonn Regional Court.

The former director, who recently retired, is said to have deliberately not told the truth when she was questioned in December.

In the process, the former Warburg general representative was charged with tax evasion.

The man was sentenced to more than five years in prison that week.

The case is explosive in that a committee of inquiry in Hamburg is dealing with the Warburg case.

A central question is why the city initially wanted to forego reclaiming more than 40 million euros from Warburg at the end of 2017.

This sum had been reimbursed to Warburg a few years earlier in connection with cum-ex deals.

The Federal Ministry of Finance (BMF) issued instructions at the end of 2017.

The Hamburg authorities were forced to demand the money back.

The former top official is said to have denied in court that there was a written instruction.

In addition, at that time the position of the BMF was "fully supported".

The public prosecutor sees this statement refuted on the basis of the files.

A spokesman for the Cologne public prosecutor's office confirmed the investigation "against a witness interrogated in the recently ended cum-ex trial before the Bonn district court."

Neither the woman nor the Hamburg tax authorities wanted to comment on the allegations.

Richard Seelmaecker, CDU parliamentary group deputy in the city parliament and chairman of the investigative committee, told SPIEGEL: "The Hamburg tax scandal involving ex-mayor Olaf Scholz and incumbent mayor Peter Tschentscher is becoming increasingly dubious." «.

Experts estimate that the state has been defrauded of more than ten billion euros with cum-ex deals by banks and lawyers.

In essence, these deals were about reclaiming more capital gains taxes on dividend distributions from the tax offices than had previously been paid.

Warburg Bank has always denied having acted unlawfully.
