After talking with the different sectors involved in the negotiation, the Minister of Labor, Claudio Moroni, resolved to

advance from the 30th to the 21st of this month

the convocation

of the Minimum, Vital and Mobile Salary Council.

And this Friday it was ratified in the Official Gazette. 

The agenda:

determine the amount

of the Minimum Salary and the minimum and maximum amounts of the unemployment benefit to be effective as of October 1.

The decision was taken after today, through decree 618/2021 published in the Official Gazette, President Alberto Fernandez set at a minimum of 4 and a maximum of 6 the number of representatives of employers and workers in the different Commissions of the Tip.".

At all times, parity will be maintained between the different sectors represented, ”says the decree.

Initially, in April, the Council had approved to

increase the Minimum Living and Mobile Wage (SMVM) by 35%

, in seven non-cumulative installments from the values ​​of April until February 2022, when it should reach

$ 29,160

.

The same percentage of increase and scheme in installments was determined for the Unemployment Benefit.

In addition, then, it was decided to reconvene the Council for September to evaluate an eventual update. 

But, in July, before the inflationary reappearance and recalls of the parity companies with increases of the order of 45%, through Resolution 6/2021, Labor advanced the quotas (in July $ 27,216, in August $ 28,080) and

established that the $ 29,160 should be in effect as of September.

Consequently, the increases that were initially supposed to cover until February of next year were advanced until September.

And that makes it necessary to convene the Minimum Wage Council again, as previously agreed.

With the Unemployment Benefit,

on August 30 the Government (Resolution 890/2021) again extended, this time until December 31

, the expiration of unemployment benefits, with limits, with the novelty of a maximum limit of 30 quotas that in total the beneficiaries reached by the successive extensions of the expiration dates may accumulate.

But the values ​​approved in April were maintained.

Thus, since July, the amounts of economic benefits for unemployment range from a minimum of $ 7,500 and a maximum of $ 12,500.

In November, they rise to $ 7,800 and $ 13,000, and in February 2022, to $ 8,100 and $ 13,500, respectively.

The Unemployment Benefit is charged by about 140,000 registered workers and dependency relationships dismissed without cause.

Meanwhile, the Labor Contract law assigns three characteristics to the minimum wage, vital and mobile.

It is the lowest remuneration that the worker without family charges should receive in cash for their working hours.

It must ensure adequate food, decent housing, education, clothing, health care, transportation, recreation, vacations and social security coverage.

And it must be adjusted periodically according to variations in the cost of living.

It is more than evident, and for a long time, that the minimum wage does not fulfill these functions despite the fact that it affects a large number of unregistered or informal workers who take that parameter as a reference.

In addition, it has an impact on work agreements with even lower incomes, as happens between provincial employees and formal workers "outside the agreement".

It also impacts almost one million beneficiaries of social plans, who receive half the minimum wage.
