Yesterday, Barnea and two other members filed an urgent application for a restraining order against the association's presidential election (which is taking place today) and to determine that Niscorn is unfit to run for office. , Reut Ushaya and Ilana Zivenberg of the Gornitzky firm, it was argued that the application lacked a factual and legal basis and relied on a trending and erroneous reading of the association's bylaws.
The association also argued that the application was submitted late, in bad faith, with an improper attempt to circumvent the democratic decision-making mechanisms of the association's institutions and clear statutory provisions, all with the aim of disqualifying Niskoren in order to gain an unfair advantage in the applicant's election.
The judge in the district court accepted the position of the hotel association and rejected the claims of Barnea and his friends. "The plaintiffs' claims about the discriminatory regulations and the need to change them are not new," the judge wrote, adding: "The parties have been negotiating in this matter for a long time." Despite this, the judge wrote: "The applicants chose to file an application for a restraining order a day before the deadline set for the election and their main claim has not yet been filed."
"More than necessary, I will add that even in examining the chances of the allegations regarding the approval of the respondent's eligibility to be accepted, alone and detached from the other allegations, I did not find room to grant temporary relief as requested."
Therefore, as stated, the judge denied the application for a restraining order and ruled that Niskoren was fit to run and that the election could continue as scheduled.
