In recent years, law enforcement agencies - the police and the State Attorney's Office - have repeatedly stated a stated policy to increase the seizures of property of suspects for forfeiture purposes. This policy led to the "forfeiture revolution."

The highlight was when the police raided the homes of dozens of criminals in the Arab sector about a week ago, in a well-timed operation, which led to the confiscation of dozens of luxury cars in the Umm al-Fahm area, with a cumulative value of no less than NIS 75 million. In another activity carried out about a week earlier, the police report that in the luxury vehicle complex in Yarka, dozens of luxury vehicles worth tens of millions of shekels were confiscated.



The scope of vehicle confiscations has jumped significantly over the past two years, as stated, due to the sharpened perception among the police and the prosecutor's office that the "traditional tools" of criminal law, ie imprisonment and fines imposed, are not enough to fight crime on any issue. Economic enforcement whose primary purpose is to deny the benefit of the monetary benefit accruing to the offender from committing the offense. One of the tools found to be effective in economic enforcement is the forfeiture of a vehicle, which means the denial of property controlled by the offender, its transfer to state property by a court order and its subsequent sale.



The main law that gives authorities the power to seize property is the Anti-Money Laundering Law.

This Act applies to operations in funds or property that were directly or indirectly produced from an offense defined in the Act as a source offense, or used to commit the same source offense that includes many offenses that characterize serious crime including violence, property offenses, drugs and terrorism.

Also violations of the Securities Act, fraud, false registration in corporation documents and more.

In addition to this law, the Dangerous Drugs Ordinance also confers forfeiture powers.

Along with the attractiveness involved in purchasing forfeited vehicles, one should know that these are usually cars sold in AS-IS mode, meaning that the buyer cannot examine the mechanical condition and sometimes basic information such as the number of miles the vehicle has accumulated or its accidental history is not available. At the same time, the transaction amounts are significantly lower than the price list.



But something else needs to be taken into account: many of the vehicles seized by the police and displayed by it to the public as part of its publications, will eventually be returned to their owners. In fact, there is a huge gap between the extent of seizures of property of suspects at the beginning of the investigation and the forfeiture of property at the end of the criminal proceedings of those caught.
