The Düsseldorf Administrative Court has obliged a tantra masseur to register as a prostitute.
The court ruled that he had to regularly take part in a consultation offered by the public health service.
With this, the judges rejected a complaint by the man against a corresponding order by the Mettmann district (file number: 29 K 8461/18).
According to the judgment, the tantra massages offered for money are sexual services within the meaning of the Prostitute Protection Act.
The plaintiff was thus to be regarded as a prostitute.
In contrast to the plaintiff's assumption, the purpose of the law, which is, among other things, the protection of health, also applies to a tantra masseur, according to the court.
The verdict is appealed
For those involved in the tantric massage, there is an increased risk of sexually transmitted diseases, it said.
Because of the complex case structure of the question of what is to be understood by a sexual act, the court expressly allowed the appeal to the Higher Administrative Court for the State of North Rhine-Westphalia in Münster.
