He gave the man notice without notice because of the threat he had made.
The labor court in Siegburg considered the termination without notice to be effective (Ref .: 5 Ca 254/21).
Both the threat of wanting to throw the superior out of the window and the announced rampage cannot be expected of the employer, said the judges.
After questioning the colleague as a witness, it can also be assumed that the plaintiff was taking his threat absolutely seriously.
A previous warning is not necessary.
The accused can appeal the judgment at the regional labor court in Cologne.
