The CGT filed a criminal complaint on Wednesday against the group of retirement homes Orpea and its "
union-house Arc-en-Ciel
" for seven offenses, in particular "
union discrimination

obstructing trade union rights

organized gang scam

The four other offenses targeted by this complaint lodged by the Federation of Health and Social Action CGT with the public prosecutor of Nanterre are: "
obstructing the constitution and operation of a social and economic committee

obstruction of collective negotiations

violation of the legislation relating to contracts of indefinite duration
", "
disregard of the legal object of a professional union
".
This complaint targets “
the actions of the Orpea group
” and the Arc-en-ciel union, indicates the CGT Health and Social Action Federation in a press release.

A work-study trainee lawyer worked for eleven months at the Orpea headquarters in Puteaux.
Exposed to many dysfunctions which offended her conscience, she made recordings during the period of organization of the elections of the UES (economic and social unit) of the group

Cancellation of professional elections
The CFDT told AFP that it also intended to file a criminal complaint very soon against the Orpea group, for concealed work and fixed-term contract fraud.
In a separate civil procedure, the CGT, the CFDT and FO asked the courts on June 23 to cancel the professional elections within Orpea, which they consider to have been manipulated by the management for the benefit of a union "

”.
The local court of Puteaux (Hauts-de-Seine), city where the Orpea group has its headquarters, has reserved its decision on September 12.
In 2019, Arc-en-Ciel had obtained nearly 60% of the vote, far ahead of the CGT, Unsa and CFDT, and had won 24 seats of staff representatives out of 35 within the CSE.
