Berlin Administrative Court: Tantra studios fall under prostitution

From a legal point of view, tantra studios are assigned to prostitution - and therefore need an operating license according to the Prostitute Protection Act.

This was decided by the Berlin Administrative Court in an urgent procedure.

Since massages are offered as sexual services in such a studio, the activities of the service providers fall under this law, the reasoning was said.

According to the court, the specific case concerned the operator of a tantra studio in the federal capital.

She wanted the court to determine that she did not need a permit for her studio under the Prostitute Protection Act.

According to the court, the applicant stated that no sexual intercourse was offered in her tantra studio.

Rather, there is an "alternative medical treatment" that is similar to a gynecological examination.

Her tantra operation is also equipped like the “wellness and spa area of ​​a hotel”.

However, the court did not follow this.

In the tantra studio, sexual acts are part of the massage.

The genital area is also included, and both participants are also naked.

According to the court, the applicant was deliberately aiming at “sexual arousal in her customers”.

Gynecological examinations are not comparable.

Customers would also have to pay money for the service.

According to the court, a two-hour massage in the applicant's studio costs around 200 euros.

According to the law, prostitutes are “persons who perform sexual acts for remuneration”.

The Tantra Studio is therefore subject to the Prostitute Protection Act.

This provides for all forms of paid sexual contact to be recorded "in order to comprehensively protect the sexual self-determination of people" who work in the professional field.

An appeal can be lodged against the decision with the Berlin-Brandenburg Higher Administrative Court.
