There is an urgent need to rethink the organization of work, judges the National Association of HRDs (ANDRH).
According to a survey carried out from February 2 to 27 among its members, 84% of respondents consider it necessary to change the labor code to adapt it to telework.
The HRDs are asking for a simplification of the monitoring of working time, a clarification of the role of the employer in terms of health and safety in telework and the establishment of a “shared responsibility”.
Health and security
The employer has an obligation to prevent the safety and health of the employee, whether he exercises on the premises of the company or at his home.
However, the labor code does not include any provision on teleworking accidents.
If an employee falls on the stairs of his company, because the ramp, poorly maintained, has given way, this negligence will be the responsibility of the employer.
His involvement will be identical if the accident occurs when the employee is teleworking at home.
