" suspension of the dates for fishing yellow eel, as well as glass eels "

in certain areas

", because they "

do not comply with European law

", in two decisions handed down on Friday .

He recalls having been seized urgently by two NGOs for the defense of the environment (the French association for the study and protection of fish and the association for the defense of aquatic environments) which requested the suspension of the calendars fixing until 2024 the opening and closing periods for eel fishing in the maritime domain.

The judge in chambers of the Council of State "

notes that the authorization schedules for glass eel fishing and yellow eel fishing in certain eel management units (UGA) do not comply with the periods imposed or to the calendar periods fixed by the European regulations

", writes the Council of State.

Consequently, yellow eel fishing “

is suspended immediately

” indicates the Council of State, due to “

the urgency attached to the conservation of eel in the UGAs concerned by the ignorance of the European regulation (all located in the Atlantic or the English Channel)

”.

He specifies that “

the economic impact of the suspension will be limited there, the fisheries in the Channel and on the Atlantic coast representing only 7.5% of the volume of yellow eel fisheries

”.

In another order, the Council of State extends the ban to all yellow eel fishing areas, for a matter of form: the contested order was only signed by the Secretary of State for the Sea, while the Rural and Maritime Fisheries Code provides that it must also be approved by the Minister for Ecological Transition.

Glass eel fishing for restocking “is therefore maintained until May 25”

With regard to glass eels (eel fry sold at exorbitant prices in Asia on the black market, threatened with extinction and banned from export outside the European Union since 2010) its fishing quotas for consumption planned "

for the current campaign, between November 1, 2022 and May 25, 2023, are exhausted

" and it "

can therefore no longer be fished today for consumption

", declares the Council of State.

On the other hand, the fishing quota intended for “

repopulation

”, via the transfer to favorable habitats, “

has not yet been reached

”.

Glass eel fishing for restocking “

is therefore maintained until May 25

” as initially planned.

The Council of State would like to point out that the silver eel fishing periods “

are not affected

”.

It indicates that "

pending the final decision on the merits (...), this suspension does not prevent the government from establishing new timetables in accordance with European law to allow the continuation of fishing activity

".
