Work Victims Are Entitled to Medication Outside the Basket: Who Deserves Cannabis Subsidy?/ShutterStock
About 6,000 work victims are recognized in Israel as eligible for subsidized medical cannabis as part of the drugs outside the basket, even though it is not considered a medicine. Many do not know that work injuries are entitled to funding for cannabis use under certain conditions.
The law defines "work injury" on two main levels: work accident and/or occupational illness. "A work accident is an accident that occurred during and as a result of the occupation of hand delivery. This includes an incident that occurred on the way to or from work, explainsAdv. Omer Harlap, an expert in torts and insurance claims, from Amikam Harlap & Co. law firm.
Occupational illness is a disease registered in the National Insurance Institute regulations and caused during work and/or due to the employment conditions of the victims. "In the event that the disease is not recognized within the framework of the regulations, it is possible to try to prove a causal connection between the disease and work and thereby obtain recognition for it as a work casualty", explains Adv. Harlap. The
state subsidizes drugs and treatments outside the basket - including cannabis: "The National Insurance Law, with its regulations and agreements, provides those recognized by it as work injuries a broad basket of treatments for recovery and rehabilitation, in order to help victims return to work when they are medically fit, This includes: medical treatment and rehabilitation included in the health basket, such as: medical consultation, tests, surgery, medications, hospitalization, nursing care at home, etc.
The subsidy comes as an exemption from payment and / or as a refund, according to the health plan price list and / or commitment forms, in addition, and this is not all work injuries know, it is possible to receive treatments and medical rehabilitation that are not included in the health basket: such as complementary medicine and even treatment with medical cannabis, in the form of an inhaler, evaporator or oils. The application for recognition is submitted to the Work Injuries Department at the National Insurance branch closest to the patient's residence, or on the National Insurance website."

Here's how to apply for a cannabis subsidy
"Funding for medical cannabis treatment expenses will be given to medical cannabis license holders only for the disability recognized by the National Insurance Institute as a work injury," Harlap explains. To apply for eligibility, the following
documents must be submitted to the health fund (personal branch):
1. Recommendation of a licensed physician on behalf of the Ministry of Health for issuing a medical
cannabis license 2.
The recommendation of a treating physician on behalf of an HMO who has expertise in the relevant medical field, who determined the need for medical cannabis treatment. For example: if the recommendation for medical cannabis treatment was given due to an orthopedic diagnosis (low back pain), the recommending doctor should be from the orthopedic field, etc.3
. Minutes of the medical committee (if several committees have been held, all minutes from all committees must be transmitted).
4. License for possession and use of medical cannabis from the Ministry of Health
According to Harlap, "The request for the subsidy, together with all the documents, will be examined by the service doctor at the health fund, and with his approval. The subsidy is provided in the form of a refund, upon presentation of purchase receipts. The application for eligibility is required every time the license for medical cannabis needs to be changed or renewed. If eligibility is denied, an appeal against the decision can be filed. As a lawyer, I have seen quite a few successes achieved in the appeal."
