The Minister of Justice Éric Dupond-Moretti announced on Wednesday that he had set up a working group intended to clear the considerable stock of cases not tried and thus reduce the time taken to adjudicate civil and criminal cases.

This working group, chaired by Peimane Ghaleh-Marzban, president of the Bobigny judicial tribunal and former director of judicial services at the Ministry of Justice, will have to deliver its conclusions by the end of March.

The minister said he was waiting for "

concrete and innovative proposals, even very innovative, perhaps even disruptive

" to "

support the implementation of the inventory clearance plan

", "

a major destocking plan

".

It's a bet

", emphasized Éric Dupond-Moretti during a press point, "

a bet which can further strengthen the links between magistrates and lawyers

".

The group is made up of 19 other members, magistrates, registry officials and chairmen.

The stock of cases not tried in the courts increased considerably in 2020 with the health crisis and after more than two months of a massive strike by lawyers against the pension reform.

During the first lockdown in the spring, all non-priority cases were postponed, resulting in thousands of hearings being postponed to later dates.

And if "

the public service of justice was maintained

" during the second confinement in the fall, this "

period did not allow old cases to be absorbed

", conceded the Keeper of the Seals.

The courts saw in the fall of 2020 their stock of civil cases increase by "

nearly 43,000 cases

" compared to the end of 2019, and "

19,000 cases

" in correctional matters, detailed the minister.

The number of pending cases has increased by "

nearly 10,000 cases

" in local courts, and "

nearly 15,000

" in labor courts, he adds.

For citizens, these stocks translate into ever longer adjudication times,

" lamented Éric Dupond-Moretti.

Among the lines of thought for the working group is the possibility for lawyers to participate in collegial hearings alongside magistrates, "

as the code of judicial organization may already allow it on very rare occasions

", noted the 'former criminal lawyer.

This expansion of the participation of lawyers in judicial activity would require legislative changes, according to the Chancellery.

I don't forbid myself anything.
