The former parliamentarian of Bouches-du-Rhône appeared before the Marseille criminal court. He gets six months in prison.

He was charged with seven offenses of illegal taking of interest, favoritism and embezzlement of public funds.

The former deputy (PS) of Bouches-du-Rhône, Jean-Pierre Maggi, was sentenced this Thursday to six months in prison by the Marseille criminal court.

Aged 76, the one who was also mayor of Velaux, near Aix-en-Provence, for 43 years, will be able to serve his sentence at home under electronic surveillance.

He also receives a 24-month suspended prison sentence and five years of deprivation of civil and civic rights, including eligibility.

The court also ordered the confiscation of an apartment owned by the elected official in Paris worth € 245,000.

"Clientelism and private interests"

Back to the facts.

He was criticized in particular for having, between 1997 and 2013, when he was president of the Departmental Fire and Rescue Service (Sdis) of Bouches-du-Rhône, signed the orders for the recruitment, tenure and promotion of his partner, her son and son-in-law.

“An error,” he admitted at the bar.

On the other hand, he contested any electoral interest in the priority hiring of young inhabitants of his commune for the “summer jobs” positions within the public establishment.

In some years, these represented more than half of the 60 to 90 seasonal workers.

"Every citizen must be assured that the one who represents the general interest serves only the general interest", indicated the court.

Before adding: “This public interest which you alone had to serve was put in competition with a political clientelist interest and a private and emotional interest.

You give the unbearable feeling that you are using your public functions for private interests ”.

The former boss of the firefighters also condemned

The prosecutor had requested against the former mayor of Velaux four years in prison, including thirty months suspended.

The court did not, however, pronounce the confiscation of a parcel of the commune of Velaux sold by the town hall, "through a covering", to the children of Jean-Pierre Maggi's partner.

But he was not alone at the stand of the accused.

The former boss of the 13 firefighters, from 1997 to 2014, Colonel Luc Jorda, 71, was also sentenced to two years in prison, including eighteen months suspended, the firm part being to be served at home under electronic surveillance .

The former firefighter was convicted of favoritism and embezzlement of public funds.

He was also banned from exercising any public office for five years and the court confiscated the undivided share of an apartment he owned with his wife in Montpellier.

The two defendants were accused of having violated the rules of public contracts for the construction in 2008 of a training center for industrial fires.
