The Civil Service Commissioner, Prof. Daniel Hershkovitz, did not approve today (Sunday) Finance Minister Israel Katz to appoint Oded Shamir as the director general of his office.

As you may recall, the latter was intended to replace Eran Yaakov, acting CEO, who has served in the position since the resignation of the Turner-Eyal Foundation last October.

According to a statement from the Civil Service Commissioner, he "accepted the recommendation of the Exceptions Committee, according to which at this time the position of Director General of the Ministry of Finance should be elected from among the civil servants.

Professor Hershkovitz sent the committee's recommendation to the Minister of Finance at noon.

"The Exceptions Committee was approached by the Minister of Finance, MK Israel Israel Katz, to the Civil Service Commissioner, according to which the Minister seeks to promote the permanent appointment of Mr. Oded Shamir to the post of Director General of the Ministry of Finance, during the election period."

"As follows from the Attorney General's directive regarding appointments during election periods, although as a general rule, a minister may appoint a CEO at his discretion, subject to the candidate's qualifications, as well as terminate his tenure, noting that this is a personal appointment of the minister. 

"Therefore, as a general rule, changes in the positions of CEOs during an election period should be avoided.

In accordance with the directive of the Attorney General above, in cases where the Civil Service Commissioner is convinced that there is a real need to replace the CEO in order for the firm to function properly, it will be possible to deviate from the said rule. However, even in these cases a senior civil servant may be appointed. The CEO. 



The Attorney General's directive also stipulates that in exceptional cases where it is appropriate to appoint a permanent CEO and not be satisfied with the appointment of a deputy, it will be preferable to appoint a CEO from among civil servants, in order to reduce damage to the firm's proper functioning and stability during the election period. Examining the request of the Minister of Finance shows that the Ministry of Finance is currently facing significant and very complex challenges that are undisputed. 

"However, despite these significant challenges and noting that the ministry has not had a permanent CEO since October 2020, it has not been clarified why the position of one of the other division heads in the Ministry of Finance will not be examined and why this possibility is not preferable in terms of proper ministry functioning.

It was also not clarified why the position could not be assigned to another senior civil servant who could fit for the job, and could even from another ministry or other economic unit from the civil service. 

"This, taking into account the required functional continuity and the frequent changes in the position, especially at this time, and when there is a possibility that after the formation of a new government, a new permanent director general will be appointed to the ministry.

In this context, it should be noted that without detracting from the candidate's qualities and skills (whose question of suitability for the position is not given to the committee), there is a possibility that the term of office of a permanent director who is not a civil servant or Ministry of Finance, and whose extensive experience does not include sufficient knowledge of work. The Ministry of Finance will not necessarily improve with the organizational and functional stability in the ministry, even considering the short period in question, the complexity of the position and the ministry and the challenges addressed by the Minister of Finance, all of which will require a certain period of study.
