“I bought a new electric scooter from a specialized website. Officially from 2018, but without any odometer reading, it broke down after three weeks. The seller took the scooter back to my home to change the battery, indicating that it will be immobilized for at least two weeks. During this time, I have to rent scooters, take the taxi, the subway ... In short, big inconvenience, costs ... and the seller tells me that he can do nothing for me. Is he obliged to compensate me during the immobilization period of the scooter? » David, Paris 18th
The response of Murielle Gasnier, lawyer at UFC-Que Choisir:
“Your seller is responsible for guaranteeing conformity defects concerning the purchase you have recently made. The breakdown suffered only three weeks after the delivery of your scooter must therefore be dealt with by your seller (repair or replacement according to your choice). This is presumed to be a lack of conformity, because it appeared within two years of the purchase. But above all, this intervention must take place at no cost to you. Also, in case of immobilization, the seller can sometimes offer you a loan scooter.
If this was not the case, and that during these two weeks you had to suffer costs, you can indeed ask your seller to compensate you for the damage suffered. Make this request in writing, preferably by registered letter with acknowledgment of receipt or email, producing your supporting documents to be reimbursed (taxi bills, metro ticket purchases, rental invoices, etc.).
If you do not get a satisfactory answer, then enter the designated mediator on his site. Finally, if your seller has granted you a commercial guarantee, be aware that any downtime of at least seven days will extend the duration of this guarantee accordingly. "
