Audiovisual: an agreement to protect copyright against platforms

The text aims to provide a framework for contracts between producers and authors, to guarantee them proportional remuneration and respect for the moral rights of their works.


The organizations of producers, screenwriters and directors signed on Friday in La Rochelle an agreement covering the audiovisual sector to protect French-style copyright against platforms, "

an important step

" according to the Minister of Culture Roselyne Bachelot.

The result of several months of discussions under the aegis of the CNC (National Center for Cinematography and Animated Image), the agreement concerns “standard

clauses

” to be included in contracts signed by producers with authors, to guarantee the principles of proportional remuneration and respect for moral rights.

Access to CNC aid will be conditional on compliance with these “standard

clauses

”, as provided for in the ordinance transposing the European AVM (audiovisual media service) directive, which imposes new funding obligations on platforms such as Netflix in the French creation.

An "

important step

" for the authors

In addition, works that do not comply with these “standard

clauses

” will not be counted in these investment obligations, shared with traditional channels.

," said Roselyne Bachelot to professionals in the sector gathered at the Festival de la Fiction de la Rochelle.
