The proceedings before the Berlin administrative court against the so-called pop-up cycle paths in the capital have been set.
That said a court spokesman for the AFP news agency.
Accordingly, the lawsuit against the cycle paths set up in the corona pandemic was withdrawn at the end of January.
The Berlin AfD MP Frank Scholtysek sued the bike paths in June 2020.
In the first instance, the administrative court ruled in September 2020 that the cycle paths are unlikely to be legal.
After a complaint from the Senate, the Higher Administrative Court overturned this decision in October 2020 in an urgent procedure.
The verdict was confirmed in January 2021.
The Senate now saw its confirmation.
"The procedure has been discontinued - an important stage for more road safety," said the Berlin Senator for Transport Regine Günther (Greens).
Scholtysek stated that continuing the lawsuit "would have cost but no change."
He criticized the court decision of January as a "politically unilateral favoritism" - and with this verbal derailment he called the independence of the court into question.
The Berlin AfD parliamentary group will continue "the fight against the red-red-green car hatred policy".
