Marie-Anne Pieri, notary in Aléria (Haute-Corse) and territorial advisor to the Assembly of Corsica, was acquitted on Wednesday April 14 by the Bastia court of appeal after being convicted at first instance in 2019 for abuse of property social.

Marie-Anne Pieri, territorial advisor of the Per l'Avvene group (regionalist right), was sentenced in June 2019 by the Bastia criminal court to two years in prison and a 50,000 euros fine.
She had been found guilty of having paid herself "
excessive remuneration
" of 34,000 euros per month over the period 2015-2016, while the average remuneration of notaries in France is 22,000 euros.
Over the same period, his office had shown a negative financial year of 87,000 euros in 2015 and 72,000 euros in 2016.
The prosecution had assessed these abuses of corporate assets at 160,000 euros.
According to case law, excessive remuneration which jeopardizes the functioning of a company constitutes an abuse of corporate assets, the public prosecutor clarified at first instance.
On February 17, during the hearing before the Bastia Court of Appeal, the general counsel, Clémence Caron, had not requested a sentence, indicating that he had “
a doubt
” about the characterization of the offense.
The notary disputed the facts and her lawyers, Me José Martini and Maxime Delhomme, had pleaded for acquittal, at first instance as well as on appeal.
