The nationwide first speed control radar is lawful. This was decided on Wednesday by the Lower Saxony Higher Administrative Court (OVG) in Lüneburg (ref. 12 LC 79/19).
In this type of radar, the pace is measured not on a single point, but on a good two-kilometer section. In order to determine the average speed, the license plates of all passing cars, regardless of their speed, are recorded and stored at short notice and anonymously. A plaintiff had filed data protection objections against the section control.
After a change in the Lower Saxony police law, there are no more significant concerns about the operation of the pilot plant, the OVG decided. That created the power of intervention. The 12th Senate has thus changed the first-instance judgment of the Hanover Administrative Court. A revision against their decision did not allow the Lueneburg judge.
Track radar back in operation

According to the Ministry of Interior, the main objective of the pilot plant is "a comprehensive and scientific assessment of the impact of the facility on traffic safety." That's why she should stay in service as uninterruptedly as possible over the next twelve months.
