Cristina Kirchner's lawyer is denounced for her role in the Advisory Council

The lawyer expert in corruption issues Silvina Martínez will report this Monday to Carlos Beraldi, before the criminal justice, for the crimes of prevaricate and violation of the ethics law of the public function, by accepting his inclusion as a member of the Advisory Council to evaluate the changes in the Supreme Court at the impulse of the Government

In his complaint, Martínez accuses Beraldi of being the defense attorney for businessman Cristóbal López and Vice President Cristina Fernández and of being on both sides of the counter in the official evaluation of the changes in Justice. 

In the complaint, which was anticipated by the La Cornisa program, Martínez assured that after being appointed a member of the Board, the board of directors of the company CPC SA, owned by Cristóbal López, approved the hiring of Beraldi to provide legal advice, signing an agreement of fee.

In addition, remember that although the members of the Council have an ad honorem position, it is established that the Ministry of Justice must take care of their travel, mobility and accommodation expenses. "The fact that the position is unpaid does not mean they do not develop a public function and considered its members as public servants , " said the lawyer.

Martínez recalled that both Cristina Kirchner and Cristóbal López and Fabián de Sousa are being accused by state agencies that assume their role as plaintiffs. The Anticorruption Office (OA) the Financial Unit (UIF) and the Federal Administration of Public Revenues, among others.

And he concluded that then, Beraldi, cannot be on both sides of the counter.

Beraldi represents the vice president in more than ten cases in which she is processed. She also defends López and de Sousa in the Oil Combustibles case, in full trial, in which both are prosecuted for defrauding the State.

Beraldi, in addition, has presented six appeals before the Court as the vice president's lawyer. 

And six other appeals, also before the Court, as defender of López and Sousa.

The lawyer gave more details: “Beraldi represents one of the parties and advises the other in a trial. And the object of the advice will impact on the other actors in the process: the judges and the prosecutors. We are facing a lawyer who represents and advises clients with opposing and incompatible antagonistic interests. The content of the claim of one of them implies the rejection of the claim of the other ”.

Martínez also considered that Beraldi would be violating the public function ethics law by failing to "look after the interests of the State " and not "refraining from using the facilities and services of the State for his personal benefit or that of any of his companies." .

He asked to investigate whether the appointment of Cristina Fernández's lawyer is to direct the investigations in process before the Judicial Power that are functional to the interests of her clients.
