- Before the proceedings began on that day at the Ebersberg district court, the defendant was already gone.

"He's standing outside smoking," said the interpreter about ten minutes after the start of an extraordinary day of negotiations.

Judge Vera Hörauf then rushed out of the room, visibly acidified, to fetch the 38-year-old.

In the meantime, however, he had not only left the building, but also the premises.

Also his defense attorney: not there.

It came about five minutes later.

However, he could not answer the question of where his client was either.

Another ten minutes later, a judicial officer entered the room and said that the defendant must have tried to avoid the trial and that he fell while trying to escape.

The defendant quickly got his injured wrist bandaged in the courthouse before he sat in the dock 30 minutes after the actual start of the trial.

Man is charged with aggravated assault

Actually, the 38-year-old man from Pakistan should have stood trial on that day for serious bodily harm before the Ebersberg District Court. Two years ago he kicked the co-plaintiff's assistance dog on the S-Bahn and then attacked her and a witness who wanted to help with a beer bottle. That was found out on the sidelines of the negotiation. Other people intervened in the event. The defendant is also said to have attacked and strangled a young man.

In court, however, the indictment was not even read out.

This was due to a motion that the co-plaintiff announced: When everyone was finally in the room, she said she wanted to have her claims for damages clarified in the process.

The documents that she had with her were not sufficient for this, explained Judge Hörauf.

"My lawyer is on vacation, so he couldn't explain it all to me," replied the plaintiff.

Difficult date issue because everyone is going on vacation

After a ten-minute pause, the judge decided to adjourn the trial.

But because witnesses, lawyers and Hörauf are planning vacation for the coming weeks themselves, it was difficult to find an appointment.

In the end, the judge reacted visibly annoyed: “Maybe we just want to take 2023?” She asked sarcastically.

The new day of negotiations has now been set for the end of September.
