District judge banned the use of masks in schools

The temporary suspension of the mask requirement at two Weimar schools may have consequences for the responsible judge at the Weimar District Court.

The public prosecutor in Erfurt confirmed to SPIEGEL that three criminal charges had been received for perversion of the law.

According to Chief Public Prosecutor Hannes Grünseisen, it is now being examined whether the allegations justify an investigation.

On Monday, a family judge upheld a mother's lawsuit who saw the health of her two eight and 14-year-old sons endangered by compulsory tests and masks as well as the requirement of distance in their schools.

The judge then ordered face-to-face lessons by means of a temporary injunction, and at the same time prohibited distance, testing and masking requirements.

Not just for the two boys, but for all the children at the two Weimar schools.

The single judge justified this step on almost 200 pages with the help of dubious evidence.

As a result, the hygiene rules put the child at risk.

So-called lateral thinkers and corona deniers had celebrated the court decision.

Constitutional lawyers, on the other hand, had expressed doubts as to whether the district judge was even authorized to issue such a blanket order for all students at the schools concerned.

The »New Judges' Association« also sharply criticized the procedure.

The decision of the single judge is "legally untenable," it says in a communication from the association.

They misunderstand fundamental legal regulations and deny "essential knowledge of science."

As the Weimar District Court announced on Tuesday in response to a request from SPIEGEL, the Thuringian Ministry of Education has now lodged a complaint against the decision.

In addition, the ministry reserves the right to apply for an oral hearing to be held.

In any case, the case should keep the judiciary busy for longer.

Complaints should apparently land specifically with judges

It is obviously no coincidence that the judge, of all people, who is now under criticism, was responsible for this procedure.

As the "Thüringer Allgemeine" reports, a lawyer in a Telegram group is said to have specifically sought plaintiffs for such a lawsuit whose children have surnames beginning with B, E, F, H, I, J, L, Q, R , S, T, U, V and X have.

According to the newspaper, these are exactly those initial letters for which the single judge is responsible according to the district court's business distribution plan.
