The first case of "Hong Kong National Security Law" was sentenced. The defendant Tang Yingjie was found guilty of one count of inciting secession and one count of terrorist activities, and was sentenced to nine years in prison.
Tan Yaozong, a member of the Standing Committee of the National People's Congress, expressed the hope that the "National Security Law" will play a preventive and deterrent role, and emphasized that someone who wants to challenge the "National Security Law" must bear criminal responsibility and the consequences brought about by the provisions of the National Security Law.
Tan Yaozong also pointed out that he hopes that the ruling will serve as a warning and avoid subversion, division, and incitement in the future.
Senior Counsel Tang Jiahua said when he was inquired by "Hong Kong 01" that he noticed that as soon as the verdict came out, some people outside the court criticized the sentence for being too heavy, but he believed that if the verdict was carefully examined, the nine-year sentence was not unreasonable, and personally believed that the deterrent was sufficient.
"If you think about it, the man in white (7.21 assault riot case) has to be sentenced to 7 years. Tang Yingjie's crime is actually more serious. It is an act of challenging the rule of law, so it is more serious."

Tang Jiahua also pointed out that the judge stated clearly in his sentence that the sentence must be deterrent, because under the National Security Law, violation of Article 1 of the Basic Law is the most serious of the four major crimes of the National Security Law.
He quoted the judge as saying that Tang Yingjie's crimes were not minor crimes. Both incitement to secession and terrorist activities were serious crimes, and the defendant had planned in advance and committed the crime on 7.1.
Tang Jiahua mentioned that in the two crimes committed by Tang Yingjie, there is a legal dispute about why part of the sentence must be executed in installments, but the verdict has been stated because the two are different criminal offences.
"For example, if the glass door is damaged during a bank robbery, the crime of torture should be included in the robbery and executed at the same time, because it was the same robbery; but if the police were killed during the pursuit, it would be another. Criminal acts must be executed in installments.” He pointed out that the judge had taken into account the nature of the defendant's crime when sentencing, so he chose to implement it in stages and partially execute it in installments.
