In a process for additional compensation for pain and suffering after the Germanwings crash more than six years ago, the bereaved suffered a defeat.
The judges at the Higher Regional Court (OLG) Hamm rejected the appeal of several relatives on Tuesday, who had demanded additional compensation of 30,000 euros from the Germanwings mother Lufthansa.
The judges of the OLG confirmed the judgment of the first instance. Like the Essen Regional Court, they took the view at the hearing that the medical supervision of pilots was a sovereign task of the state. In this respect, Lufthansa is not the right addressee for the claims for damages, which are also not sufficiently well-founded.
According to the investigation, on March 24, 2015, the co-pilot, who used to suffer from depression, deliberately steered the plane into a mountain in the French Alps.
All 150 inmates were killed.
The plaintiffs accused Lufthansa of neglecting the aero-medical examinations and consider the compensation for pain and suffering paid so far to be insufficient.
The verdict is not yet legally binding.
The OLG did not allow the appeal.
The plaintiffs can lodge a complaint against this.
