The Ottenhofen community issues a playground statute.
The decision in the local council was unanimous.
The legal basis is the redesign of the building code, which makes it possible to replace playgrounds in apartment buildings, but also sets quality standards.

- the background to this is the long-standing obligation for owners of apartment buildings to also create a playground. There is a model statute for the parish council that is already being implemented by some parishes. A political decision on the amount of the transfer fee is not permitted; the municipalities are obliged to give precise reasons for this. Standard land value, manufacturing and maintenance costs play a role here. A transfer fee of 33,000 euros comes out for Ottenhofen. The administration sees this as a reasonable amount, because the investor could create the necessary parking space here and save the maintenance costs. The funds flow to the community for a specific purpose: it has to create and maintain playgrounds for this purpose.
When asked by the municipal council, the administration made it clear that proof of this use could be provided without any problems.
For example, the building yard services for the maintenance of existing systems would also be recorded.
However, according to Mayor Nicole Schley (SPD), the state government has not yet finalized the provisions.
"So that's not yet set in stone."
There is no obligation to redeem.
If the client decides to build a playground for his apartment building and then maintain it himself, he has the right to do so, according to the mayoress.
If a transfer is sought, the contract, which has to be approved by the municipal council, must be concluded before the building permit is granted.
But there is also a certain amount of political pressure: the statutes contain some criteria for what such a playground should look like.
The aim of the Free State's legislation is to get playgrounds that are then also accepted.
Because often enough there are pure cheap solutions: a bank, a small sandpit, when it comes up a feathered animal, everything in the worst place - that is often enough.
Things like that are over now, quality is required.
But the municipal council does not want the builders to maneuver either.
That is why he wants to noticeably defuse the requirements from Munich.
