After several days of arduous negotiations and extensions, Walmart and the Truckers union, led by Hugo Moyano, were

unable to resolve the dispute

, whose epicenter is the chain's strategic distribution and logistics center in the town of Moreno. Sources from the company, which belongs to the De Narváez Group since November last year, confirmed to

Clarín

that "

the mandatory conciliation ended and there was no agreement between the parties,

" without giving further details. On several occasions,

Moyano had been threatening measures of force

, including a strike, if they did not accept his demands.

The lynchpin of the fight is the sale of Walmart to De Narváez. For this reason, the union

demands that they compensate and take back 500 members

who work in the distribution center from which they supply its 92 branches, something that the company considers "an illegitimate practice, not foreseen by any legal framework. current". Asked about it,

the union did not respond to Clarín's calls

.

The conflict was exposed at the end of March, with the publication of a requested one in the major national media, entitled "

Everything within the law, nothing outside the law

." There they detailed that the Moyano claims began as soon as the De Narváez group took control of the chain and that, faced with the rejection, "we were conditioned by recurring covert measures of force that resulted in a 75% drop in the distribution of staple foods ".

To stop protests, the labor portfolio, led by Claudio Moroni, dictated the mandatory conciliation, first for 15 days and then for another week, to force the parties to negotiate. Once the deadlines were exhausted, this Monday and against the clock,

two extensions were agreed to continue the dialogue

. This past Thursday noon, it was all over. "

It was a dialogue of the deaf

. The union maintained its claim to compensate and retake the 500 employees for the change of ownership and the company considers this to be illegal.

None changed their position and the conflict returns to zero,

" explained a source aware of the negotiations.

Weeks ago, the Minister of Labor, Claudio Moroni, supported Walmart's position. The official said that Truckers "

demands the payment of compensations that we do not understand what the origin is

" and said that "there is no regulation that binds the company." Pablo Moyano responded firmly: "No matter how much De Narváez says it is not appropriate, we will continue to insist in all ways so that they pay the compensation. Since 98 we have this conquest and all (the companies) paid and

the only one alive It's from Narváez,

"he said.

Truckers argues that their claim refers to the "Manliba case", something known as the "Moyano Law", something that is considered an acquired right even though it is not contemplated in the legislation. In the 90s and when the concession of the waste collection company (belonging to the Socma group of the Macri family) expired, Moyano agreed to pay the dismissals and keep their positions in the successive renewals of the concession contracts. The formula was replicated with logistics, postal and carbonated water companies, among others.

The Government is unable to cool down a dispute that did not stop escalating despite the mandatory conciliation. Something that is still striking if one takes into account that Hugo Moyano and Francisco De Narváez are old acquaintances. Without going any further,

in 2013 they were allies

on the same list to compete in legislative elections, in what was the last political participation of the former owner of Tía. Due to that antecedent, many believe that both spoke throughout the conflict.

The pulse continues and its end is uncertain. In market share, Walmart is positioned behind Carrefour, Cencosud (Jumbo, Disco and Vea) and Coto. Today it has a 12% market share and is in the process of restructuring. It has 31 hypermarkets (with the Walmart brand), two wholesale stores (Punto Mayorista) and the rest are supermarkets that carry the Changomas flag. It has a total of 10,000 employees and the conflict is centered on its only distribution and logistics center, where just over 700 workers work.
