The CFDT Santé-sociaux has filed a criminal complaint against X with the Nanterre prosecutor's office for five offenses relating in particular to employment contracts and union life within the group of private nursing homes Orpea, she said on Thursday.

The five offenses targeted by this complaint filed by the CFDT Social Health Federation are: "

hidden work

abusive use of fixed-term employment contracts

fraud

", "

union discrimination

" and "

obstructing union practice

" , according to a copy of the complaint seen by AFP.

The CFDT relied on elements of the investigative book "

" and on individual testimonies that it collected to file a complaint, Frédéric Binet, federal secretary of the union, told AFP.

At the end of June, the CGT had already filed a criminal complaint against Orpea and its "

house union

" Arc-en-Ciel for seven offenses, including "

union discrimination

".

In a separate civil procedure, the CGT, the CFDT and FO asked the courts on June 23 to cancel the professional elections within Orpea, which they consider to have been manipulated by the management.

The local court in Puteaux, where Orpea has its headquarters, will deliver its decision on September 12.

In 2019, Arc-en-Ciel won 24 staff representative seats out of 35 within the CSE.

In criminal matters, Orpea has also been targeted since February by a preliminary investigation on suspicion of "

forgery and use of forgery

" and breach of labor legislation.

Government reporting to court

For its part, the government issued, at the end of March, a report to the justice causing, at the end of April, the opening of a preliminary investigation for institutional mistreatment and financial offenses.

The investigators are also digging into more than forty complaints, the majority of which were filed collectively in early April by families of nursing home residents, who accuse Orpea of ​​"

endangering the lives of others

" and of "

manslaughter

".

This nationwide investigation gave rise to “

several hearings

” according to the prosecution, then to “

about fifteen searches

”, on June 8, at the group's headquarters and in several Orpea establishments.

At the same time, a separate preliminary investigation was opened in mid-May in Nanterre, in particular for abuse of corporate assets, after a complaint by Orpea against X.
