The suspect, who was serving a five-year sentence, had been released early "by a sentencing judge on the basis of criticism.

The Minister of Justice returned to the case of the former detainee accused of rape by a 17-year-old minor on Wednesday evening, six months after his release from Lyon-Corbas prison.

The man had been sentenced to five years in prison, including a suspended sentence in 2018 for violence and sexual assault on his partner.

He was released from prison early on May 4, 2020, but not for health reasons, emphasized Eric Dupond-Moretti on Wednesday evening on the set of BFMTV.

“6,600 detainees have been released for health reasons.

Nicole Belloubet did it and she was right to do it.

It took into account the detainees but also the prison staff.

This man is not one of them.

This man was released by a sentencing judge based on traditional criteria (psychological expertise, work by probation integration services, etc.) ”, insisted the Minister of Justice.

Returning to the case, the minister recognized "a tragedy for both this young woman and her family".

"There is this absolutely dramatic recidivism which is a failure but, for all that, should we question parole when I tell you that it reduces the risk of recidivism by 50%?

», He continued.

A "gross fault" according to the family of the victim

As a reminder, the family of the teenager has indicated its willingness to file a complaint against the State for "gross negligence".

According to the plaintiff's lawyer, Fabien Rajon, the suspect had benefited from the release decided for more than 6,000 detainees across the country a few months ago to unclog prisons and thus slow the progression of Covid-19.

His release would have been decided by the sentence enforcement judge, "at the request of the convicted person and after a favorable opinion from the prison service for integration and probation, the prison administration and the Lyon public prosecutor's office".

An expert psychiatrist had estimated that the risk of recidivism of the condemned was "low", had specified the prosecution.

"The person, released on November 20, 2021, was in the legal conditions for granting parole since January 6, 2020," he added.
