RATP sentenced to industrial tribunal in a case of sexual harassment

The complainant had reported facts of sexual and moral harassment, and had noted the slowness and shortcomings within the management to investigate.


The Paris industrial tribunal, seized by an agent of the RATP, condemned the management on Wednesday for sexual harassment, but rejected the complainant of her request for judicial termination of her employment contract.

The transport organization is ordered to pay "

15,000 euros in damages for sexual harassment

" and the agent was "

dismissed of her other requests

", told AFP the office of Me Sophie Maltet, the lawyer of the management.

We obtain the recognition of sexual harassment

", with a conviction of the RATP to pay "

", but the industrial tribunal "

did not draw all the consequences and did not pronounce the termination judicial. They did not go to the end of the process,

”regretted to AFP Me Maude Beckers, the lawyer for the complainant. Judicial termination of the employment contract can be requested by an employee who accuses his employer of serious breaches of his obligations. If the judicial termination is pronounced, the employment contract is terminated and the employer must pay the employee severance pay.

After the hearing in October, the judgment rendered Wednesday is "

mixed

", commented Me Beckers. This decision, with on the one hand a conviction and on the other hand a rejection of the request for judicial termination, "does

not really make legal sense

", she said. By condemning the RATP for sexual harassment, there is however "

recognition of the violation by the employer of its safety obligations

" towards the employee and "

the RATP will have to seriously question itself

", considered the lawyer. "

At the hearing on October 20, Me Beckers had listed the "

different types of harassment suffered

" by his client: sexual harassment, sexual harassment of environment and moral harassment.

She had also noted the slowness and shortcomings within the management to investigate this case.

Currently, his client is "

on sick leave and her state of health is incompatible with a return to work,

" added Me Beckers.
