Ride on the electric skateboard leads to criminal charges

This recently happened to a 16-year-old from Starnberg. The youngster was noticed by a patrol from the Starnberg police station because he was riding a longboard on the bike path between the forest playground and Gut Schmalzhof. Nothing particularly noticeable in itself - if it hadn't been for an uphill climb without even pushing yourself once. During the inspection, the officers found that the board had an electric drive and was operated with a remote control. 

However, it is not so much the remote control as the drive that now poses the problems: The board is thus a motor vehicle. This classification means that the board would have to be approved. However, it cannot get approval because the building regulations of the StVZO have to be observed - and these include speedometers, indicators, lights and brakes. A driver's license is usually required to drive a motor vehicle. There are no exceptions for such vehicles; a class B driving license would actually be required. The next requirement to put a motor vehicle into operation: a motor vehicle liability insurance. You will probably not get insurance coverage from any insurance company.Ultimately, a vehicle that is subject to registration - even if it is not registered at all - is basically also subject to vehicle tax.

Often none of these points are considered when buying such a "toy".

The often hidden reference to the lack of road approval also does not seem as if there could be problems if you drive it anyway.

The reality is then unfortunately different - the 16-year-old now has to answer criminally.

The police have no discretion here.
