Neighborhood dispute about keeping horses (symbol photo)

Plaintiffs from Saxony-Anhalt have a claim that they are not disturbed by loud neighing and blows from a horse stable just twelve meters from their house.
That was decided by the Federal Court of Justice (BGH) in Karlsruhe.
The BGH forbade the owner of the horse farm to hire horses there again.
The stable was built without a building permit, and according to a legally binding administrative court ruling, this cannot be granted retrospectively - that requires consideration for the residential building.
The BGH judges decided that this also justified a civil law injunction.
Nevertheless, the dispute is not quite over yet: The lawsuit was also directed against a riding school whose manager is the owner of the horse farm.
It is not known whether horses from the riding school were ever in the stable.
That must now be clarified at the higher regional court in Naumburg.
As a result, however, it must be ensured in any case that the neighbors are protected from the annoying noise from the open stable with access in the future.
